Terms and Conditions

 

KiksAR is continuously evolving platform, with most of the features mentioned below in Alpha and Beta Testing Stages and you may not find some of the points being applicable to your usage context of KiksAR platform at this point of time. However, by agreeing to our terms and conditions below, you are giving consent to our Data Policy and Usage of the information collected. KiksAR reserves the right to turn-on or turn-off any of the features or data collection mentioned below at any point of time.

 

Using our Services

 

You must follow any policies made available to you within the Services.

Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.

Our Services display some content that is not KiksAR’s. This content is the sole responsibility of the entity that makes it available.

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

 

Modifying and Terminating our Services

 

We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.

You can stop using our Services at any time, although we’ll be sorry to see you go. KiksAR may also stop providing Services to you, or add or create new limits to our Services at any time.

We believe that you own your data and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that Service.

GENERAL

By installing the Application (as defined below), you agree to be bound by these terms of use (“appterms”). Please review them carefully before installation and/or acceptance.

DEFINITIONS

The “Application” shall mean the software provided by KiksAR to offer services related to Ideal Standard, Ideal Standard’s services and its partners’ services, to be used on any web browser on any of the devices connected to internet, Apple iOS and Android OS devices and any upgrades from time to time and any other software or documentation which enables the use of the Application.

DATA PROTECTION

Any personal information you supply to KiksAR when using the Application will be used by KiksAR in accordance with its Privacy Policy.

PROPRIETARY RIGHTS AND LICENCE

All trademarks, copyright, database rights and other intellectual property rights of any nature in the Application together with the underlying software code are owned either directly by KiksAR. 
KiksAR hereby grants you a worldwide, non-exclusive, royalty-free revocable licence to use the Application for your business and personal use in accordance with these APP terms.

CONDITIONS OF USE

You will not, nor allow third parties on your behalf to (i) make and distribute copies of the Application (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind whatsoever. 


The Application is currently made available to you free of charge for your personal, non-commercial use. KiksAR reserves the right to amend or withdraw the Application, or charge for the application or service provided to you in accordance with these appterms, at any time and for any reason. 


You acknowledge that the terms of agreement with your respective mobile network provider (‘Mobile Provider’) will continue to apply when using the Application. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the

AVAILABILITY

This Application is available on all browsers connected to internet, handheld mobile devices running Apple iOS and Android OS Operating Systems. KiksAR will use reasonable efforts to make the Application available at all times. However you acknowledge the Application is provided over the internet and mobile networks and so the quality and availability of the Application may be affected by factors outside Ideal Standard’s reasonable control. 
KiksAR, its group of companies and sub-contractors do not accept any responsibility whatsoever for unavailability of the Application, or any difficulty or inability to download or access content or any other communication system failure which may result in the Application being unavailable. 

SYSTEM REQUIREMENTS

In order to use the Application, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications ('Software Requirements').

The version of the Application software may be upgraded from time to time to add support for new functions and services.

TERMINATION

KiksAR may terminate use of the Application at any time by giving notice of termination to you. 
Upon any termination, the rights and licenses granted to you herein shall terminate with immediate effect.

 

 

Data Policy

What kind of information do we collect?

 

To provide the best experience for you, we must process information about you. The type of information we collect depend on how you use our Product.

 

Things you and others do and provide.

  • Your usage.We collect information about how you use our Products, such as the types of content you view or engage with; the features you use; the actions you take; and the time, frequency and duration of your activities. For example, we log when you're using and have last used our Products, and what category, brands and other content you use on our Products. We also collect information about how you use features like our camera and Screen sharing features
  • Information about fulfilment made on our Products.If you use our Platform for fulfilment, we collect information about the purchase or transaction. This includes payment information, such as your credit or debit card number and other card information; other account and authentication information; and billing, shipping and contact details.
  • Things others do and information they provide about you.We also receive and analyse content, communications and information that other people provide when they use our Products. This can include information about you, such as when others share or send a message to you.

 

 

 

 

Device Information

 

As described below, we collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Platform, and we combine this information across different devices you use. For example, we use information collected about your use of our platform on your phone to better personalize the content or features you see when you use our Products on another device, such as your laptop or tablet, or to measure whether you took an action in response to an ad we showed you on your phone on a different device.

 

Information we obtain from these devices includes:

  • Device attributes:information such as the operating system, hardware and software versions, battery level, signal strength, available storage space, browser type, app and file names and types, and plugins.
  • Device operations:information about operations and behaviours performed on the device, such as whether a window is foregrounded or backgrounded, or mouse movements (which can help distinguish humans from bots).
  • Identifiers:unique identifiers, device IDs, and other identifiers, such as from games, apps or accounts you use, and Family Device IDs
  • Device signals:Bluetooth signals, and information about nearby Wi-Fi access points, beacons, and cell towers.
  • Data from device settings:information you allow us to receive through device settings you turn on, such as access to your GPS location, camera or photos.
  • Network and connections:information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed and, in some cases, information about other devices that are nearby or on your network
  • Cookie data:data from cookies stored on your device, including cookie IDs and settings.

Provide, personalize and improve our Products.

 

We use the information we have to deliver our Products, including to personalize features and content  and make suggestions for on and off our Platform. To create personalized experience that are unique and relevant to you, how you use and interact with our service; and the people, places, or things you're connected to and interested in on and off our platform.   • Information across KiksAR Platforms and devices:We connect information about your activities on KiksAR Platforms and devices to provide a more tailored and consistent experience on KiksAR Platforms you use, wherever you use them.
  • Location-related information:We use location related information such as your current location, where you live, and the businesses and people you're near-to provide, personalize and improve our Platform experience. Location-related information can be based on things like precise device location (if you've allowed us to collect it), IP addresses, and information from you.
  • Product research and development:We use the information we have to develop, test and improve our Products, including by conducting surveys and research, and testing and troubleshooting new products and features.
  • Face recognition:If you have it turned on, we use face recognition technology to recognize you in camera experiences. The face-recognition templates we create may constitute data with special protections under the laws of your country.
  • Ads and other sponsored content:We use the information we have about you-including information about your interests, actions and connections-to select and personalize ads, offers and other sponsored content that we show you.

 

Provide measurement, analytics, and other business services.

 

We use the information we have (including your activity off our Products, such as the websites you visit and ads you see) to help advertisers and other partners measure the effectiveness and distribution of their ads and services, and understand the types of people who use their services and how people interact with their websites, apps, and services. Learn how we share information with these partners.

 

Promote safety, integrity and security.

 

We use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad experiences, maintain the integrity of our Products, and promote safety and security on and off of KiksAR Platforms. Sharing on KiksAR Platforms

 

People and accounts you share and communicate with

 

When you share and communicate using our Platform, you choose the audience for what you share. For example, when you post on KiksAR, you select the audience for the post, such as a group, all of your friends, , or a customized list of people.

 

You should consider who you choose to share with, because people who can see your activity on our Products can choose to share it with others on and off our Products, including people and businesses outside the audience you shared with. For example, when you share a post or send a message to specific friends or accounts, they can download, screenshot, or re-share that content to others across or off our Products, in person or in virtual reality experiences such as KiksAR Sharing.

 

Sharing with Third-Party Partners

 

We work with third-party partners who help us provide and improve our Products or who use KiksAR platform Business Tools to grow their businesses, which makes it possible to operate our companies and provide free services to people around the world. We don't sell any of your information to anyone, and we never will. We also impose strict restrictions on how our partners can use and disclose the data we provide. Here are the types of third parties we share information with:

 

Partners who use our analytics services.

 

We provide aggregated statistics and insights that help people and businesses understand how people are engaging with their Products. For example, business or organisations will receive information about your category preference, product preference and which brand is most liked by you for experience,  as well as aggregate demographic and other information that helps them understand interactions with their

 

Advertisers.

 

We provide advertisers with reports about the kinds of people seeing their ads and how their ads are performing, but we don't share information that personally identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us permission. For example, we provide general demographic and interest information to advertisers (for example, that an ad was seen by a woman between the ages of 25 and 34 who lives in Madrid and likes software engineering) to help them better understand their audience. We also confirm which KiksAR ads led you to make a purchase or take an action with an advertiser.

 

Vendors and service providers.

 

We provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analysing how our Products are used, providing customer service, facilitating payments or conducting surveys.

 

Researchers and academics.

 

We also provide information and content to research partners and academics to conduct research that advances scholarship and innovation that support our business or mission, and enhances discovery and innovation on topics of general social welfare, technological advancement, public interest, health and well-being.

 

Law enforcement or legal requests.

 

We share information with law enforcement or in response to legal requests in the circumstances outlined below.

 

How can I manage or delete information about me?

 

We provide you with the ability to access, rectify, port and erase your data

We store data until it is no longer necessary to provide our services and KiksAR Products, or until your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs.
